🔹 1. Introduction
These Affiliate Terms & Conditions (“Agreement”) govern participation in the Book n Earns Affiliate Program (“Program”).
By signing up or promoting properties via Book n Earns, you (“Affiliate,” “Partner,” or “Marketer”) agree to the following terms.
This Agreement outlines rights, responsibilities, commissions, promotional methods, and compliance obligations for all affiliates.
🔹 2. Program Overview
The Book n Earns Affiliate Program allows approved partners to promote accommodations, travel services, and promotional deals listed on our platform in exchange for referral commissions.
Our goal is to expand property visibility and enhance booking opportunities through trusted affiliates.
🔹 3. Eligibility
To join the Program, you must:
- Be at least 18 years old.
- Operate a valid website, app, or social media account.
- Do not promote illegal, adult, or harmful content.
- Agree to comply with the Philippine Data Privacy Act, GDPR, and Book n Earns policies.
Book n Earns reserves the right to approve, reject, or terminate any affiliate at its discretion.
🔹 4. Commission Structure
💰 Commission Basis:
Affiliates earn a percentage of the net booking value (excluding taxes and fees) when a user completes a valid booking via the affiliate’s unique tracking link.
💳 Commission Payment:
- Payouts are processed monthly via PayPal, bank transfer, or other agreed methods.
- Minimum payout threshold: USD 50.
- Canceled, refunded, or fraudulent bookings are excluded.
⏱ Payment Schedule:
Commissions are paid within 30 days after the month in which a completed booking occurs.
🔹 5. Promo Codes & Discounts
To attract more affiliates and users, Book n Earns may release promo codes offering up to 5% discount on a property’s published rate.
Affiliates can share these codes with their audiences to increase bookings.
Conditions:
- Promo codes are provided by Book n Earns only.
- A discount is applied at checkout automatically when a valid affiliate link or code is used.
- Affiliates may not create their own promo codes or misrepresent offers.
🔹 6. Affiliate Responsibilities
Affiliates agree to:
✅ Promote Book n Earns properties ethically and accurately.
✅ Use only approved branding materials, links, and banners.
✅ Not engage in misleading advertising, spamming, or cookie stuffing.
✅ Keep user data confidential and comply with privacy laws.
✅ Immediately remove any outdated or invalid promotions upon notice.
🔹 7. Intellectual Property
All logos, brand names, and content related to Book n Earns Inc. remain the company’s property.
Affiliates receive a limited, non-transferable license to use marketing materials solely for promotional purposes.
Unauthorized use or modification of branding is strictly prohibited.
🔹 8. Termination
Either party may terminate participation at any time with written notice.
Book n Earns may suspend or terminate an affiliate account for:
- Policy violations
- Fraudulent activity
- Misuse of brand assets
- Legal or reputational risks
Upon termination, affiliates must remove all links, logos, and promotional materials immediately.
🔹 9. Limitation of Liability
Book n Earns shall not be held liable for:
- Loss of income, data, or business resulting from Program participation.
- Technical errors, downtime, or system interruptions.
- Indirect or consequential damages.
Total liability is limited to the commission earned by the affiliate in the preceding 3 months.
🔹 10. Confidentiality
All affiliate reports, statistics, and communications are confidential.
Affiliates must not disclose this information to any third party without written consent from Book n Earns.
🔹 11. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the Republic of the Philippines.
Any dispute arising from or related to this Program shall be resolved through amicable negotiation, and if unresolved, submitted to arbitration in Olongapo City, Philippines.
